Here are the Terms and Conditions ("Terms") governing your access to and use of the TestBots.ai platform, website, and related services (collectively, the "Service" or "Platform"), provided by TestBots.ai ("TestBots.ai", "we", "us", or "our").

By accessing, registering for, or using the Service, you ("Customer," "User," or "you") agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.

1.1 Nature of the Service. TestBots.ai is a SaaS platform designed to assist in software quality assurance through automated test generation, execution, and reporting.

1.2 Dependence on Artificial Intelligence. You acknowledge and agree that a core component of the Service involves the use of Generative AI, Large Language Models (LLMs), and machine learning algorithms (collectively, "AI Models").

1.3 Nature of AI Output. The test scripts, code snippets, data suggestions, and remediation steps generated by the Platform ("AI Output") are probabilistic predictions based on patterns in data.

• (a) No Guarantee of Accuracy: TestBots.ai does not guarantee that AI Output will be accurate, complete, secure, bug-free, or free from "hallucinations."
• (b) Human Verification Required: The Service is a tool to assist human workflows, not replace them. You are solely responsible for reviewing, verifying, and testing any AI Output prior to deploying it.

2.1 Customer Data Definition. "Customer Data" means any data, content, software code, application screenshots, or information that you submit, upload, or transfer to the Service.

2.2 Data Usage License. You grant TestBots.ai a limited, non-exclusive right to use your Customer Data solely to provide, maintain, and improve the Service for you.

2.3 AI Model Training. TestBots.ai does not use your specific Customer Data to train our foundational LLMs or to improve models shared with other customers. Your data remains isolated.

2.4 Third-Party AI Providers. We may utilize third-party providers (e.g., OpenAI, Anthropic, Azure) to host LLMs. Data submitted to the AI may be processed on the infrastructure of these third parties.

3.1 TestBots.ai IP. We own all rights, title, and interest in and to the Platform, its underlying software, methodology, and the pre-existing AI Models.

3.2 Customer Ownership of AI Output. Subject to compliance with these Terms and payment of fees, you own all rights to the specific AI Output generated for you by the Service.

You agree not to, and not to permit any third party to:

• (a) Reverse engineer the AI Models or attempt to discover the underlying prompts, weights, or training data.
• (b) Use the Service to test applications that are illegal, harmful, or promote malicious activities.
• (c) Input sensitive PII, PHI, or classified data into prompt fields unless explicitly authorized.
• (d) Attempt to "jailbreak" or manipulate the AI Models to generate output that violates these terms.

6.1 "AS-IS" Service. THE SERVICE, INCLUDING ALL AI-DRIVEN FEATURES AND SELF-HEALING CAPABILITIES, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

IN NO EVENT SHALL TESTBOTS.AI BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR BUSINESS INTERRUPTION.

IN NO EVENT SHALL TESTBOTS.AI'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT PAID BY YOU DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless TestBots.ai from any claims, damages, or losses arising from: (i) your use of the Service in violation of law; (ii) your deployment of flawed AI Output; or (iii) claims that your Customer Data infringes the rights of a third party.

These Terms shall be governed by the laws of Ontario, Canada. Any dispute shall be resolved through binding arbitration in Toronto, Ontario, except that either party may seek injunctive relief to prevent irreparable harm to IP rights.
